    PS make sure they know it’s either the reroute around same time or you will be excercising your right to claim hotel and meals for any extra wait time which they are trying to make 2 days plus transport to and from hotel etc. And that there are 7 of you.

    Know that you will get your money back but be aware you may well have to go through the claim – letter before action – mcol or ADR route to get it – whether you end up forced to buy your own flight on same day or 2 days hotel+meals – involving admin and chasing over a few months

    Thank you for this. I agreed to the flight 2 days later. I have been in email correspondence with them and have let them know I will be exercising my rights to compensation etc

    Be careful about terminology. You have no right to compensation under EC261 as you were informed more than 14 days in advance. You do have a right to care (article 9).

    Have a look at “Regulation (EC) No 261/2004 of the European Parliament and of the Council” on legislation.gov.uk (I’d put a link in but it will probably cause my post to disappear into moderation).

    As well as the correct terminology ensure you formally ask them to provide you a hotel – or the extra days in your existing accommodation if it’s at market rate for the location – for the extra 2 days you now need to wait for the new flight.

    Also mention you will be claiming meals, transport to and from the hotel, and internet (the alternative is only a couple of phone calls so keep it reasonable if internet) under duty of care EU261 and UK equivalent. Whatever they say, note what they said, ideally who they were, and date and time of the call. You must legally be seen to have given them a chance to provide these things before going ahead and sourcing them yourself. You will eventually get your money but it is a process to go through and will take time and care as above. So make sure you are seen to give them the opportunity to provide.

    I have received an email back from virgin sending me to a page where I can claim any expenses. Does that mean I should go ahead and pay reasonable expenses myself and expect them(eventually) to reimburse?

    Also, on the return, changed flight, they are unable to give us seats together. We are a party of 7 with children. What are my rights?

    I think it will be something along the lines of them guaranteeing there will definitely be an adult from your group next to each child who is below the age of “xxx” (16? 12?).
