    Yes, I have no doubt BA evaluated the cost of an extra pilot and decided that based on how often they estimated they would need one, combined with cost and other consequences when that happened, they would take the risk and not roster an extra pilot.

    Obvs EU/UK261 potential costs (mitigated by the extent they felt / wished to bring about they wouldn’t be paying them to all passengers potentially affected) were part of their evaluation.

    This is for their business to decide.

    @highnal – It’s disappointing BA is still being difficult about the delay claim which you will now need to escalate to MCOL. As mentioned previously, I’m a little concerned that BA might concoct a good enough story for CEDR in view of the less clear English law precedents re crew sickness at an outstation, even if the principle of the provision of crew is deemed to be an inherent part of an airline’s activities. MCOL would probably be a cleaner result but involves paying fees and much more work and a Supreme Court judgment that worsened the position could cause all that to be wasted. As either CEDR or MCOL is highly unlikely to get very far before the Supreme Court decision, it may be worth waiting for it as if it maintains the current position, you could press BA again and if it’s negative the case is over but you haven’t lost anything.

    Re the £300 cash/ £400 for the en route downgrade, I would think that seems not overly generous but quite reasonable even though there’s nothing to benchmark it against. I’m not sure looking at it as paying back the taxes is right because I think you may have paid more cash / less Avios as the RFS on this route is £225pp each way.

    No idea I’m afraid although I hope it will be before the end of the Trinity term on 31 July. Judgments are handed down on Wednesdays.
