Forums Other Flight changes and cancellations help BA refusing compensation

  • 1 post

I was on a heavily delayed BA108 from Dubai on 2nd May . There was a storm overnight, nothing too heavy and traffic was moving fine without issue. No repeat of the floods a couple of weeks earlier.
24 hours before the BA App was showing approximately a 1 hour delay, which seemed a little odd.
The flight was initially delayed due to a change of aircraft at Heathrow, followed by the cabin crew arriving late in anticipation of delays, so as not to go over hours. We were then boarded and kept on the plane for over two hours, we’d missed our slot, then there were further delays as distressed passengers disembarked. We eventually arrived nearly 5 hours late.
I’ve made a claim to BA for compensation which they’ve refused blaming the weather and citing Article 5.3 of the EU Regulation 261/2004.
There is no acknowledgement of the consequences of the issues within their control or the fact the two other flights from Dubai on the same day didn’t have issues.
Should I try and escalate the claim with BA, or is that a waste of time?

I would consider myself a regular flier with over 40 flights so far this year with IAG airlines already. But this is the worse treatment I’ve experienced for some time.

@WVS411 – this is a slightly difficult one as there are compound reasons for your five hour delay and BA may be able to concoct reasons to take any element for which they might be responsible to ensure the resulting delay is under three hours. The thing about other aircraft flying is an irrelevance in a weather related situation. If you want to pursue the matter, you need to press BA for a more considered response as weather was not responsible for a five hour delay. If you are still not satisfied with their response, take the matter to CEDR and BA will have to prove to them the reasons for the delay were outside its control.

2 May was the day of forecast of further storms in the region. My daughter was going to Abu Dhabi for work last Wednesday (arrival on 2nd) but changed her flight to the day before to avoid arriving during the predicted storm. I think she received a message in advance warning her of possible storms/floods.
