    If it’s been 8 weeks since you first contacted BA, then go to CEDR. If it’s not been 8 weeks yet, then reply to the latest nonsense and ask them to confirm that their answer will not change – that is then deadlock, which you can take to CEDR.

    There’s very little point replying again and again to BA – they are very unlikely to actually reconsider.

    I would normally agree to go straight to CEDR or MCOL but in this instance I would press BA again, partly because this second response is such generic nonsense, but more particularly because in the case of crew illness, BA has form for creating a good enough story for CEDR to agree with its defence.

    In terms of reconsidering, I usually find BA to be very pragmatic once they escalate it. Unfortunately, the policy of pushing back is very successful in making claims go away, but there comes a point where they give but one needs to be very firm but polite with them. I think writing to the legal team has become rather less effective as too many people do that.
