    Delayed 9 hours on the return leg from Nassau due to pilot testing positive for COVID.

    I’ve submitted my compensation claim but fully expect the “exceptional circumstances” due to COVID excuse.

    Can I ask for proof of the pilots positive test?

    The excuse seems to convenient considering this was the week of BAs IT meltdown.

    You can certainly ask for it.

    But I suspect it would be very rare for a company to disclose the healthcare records for any of their staff without a court order.

    Staff illness isn’t a reason to deny compensation, I’m pretty sure this has been upheld previously. BA can’t simultaneously deny the claim and refuse to provide evidence for its position (well they can, but I imagine CEDR would overrule them).

    Someone posted yesterday about NAS-LHR flights being cancelled several days in a row – was this one of them? Might be part of a bigger picture if so.

    Defo claim compo.
    Obvs you have a separate right to full duty of care things, regardless of the reason for cancellation or delay, and regardlesd of how far ahead any cancellation was notified.

    Previous judgments seem to have implied airlines are expected to have backup crew available even at outstations.

    Defo pursue the claim and make them prove it was exceptional, good chance they can’t

    I suspect you’ll have to fight it and here I’d really suggest going to MCOL rather than CEDR. CEDR might be more inclined to rule in favour of BA as they do not fully understand all the details of EU case law.
